Part 1 of 2
Judson, you have
stated: Democrats have an unconstitutional poison pill called Obamacare.
Why do you say it literally destroy the Constitution, therefore, it is a poison
pill?
As an attorney, explain to our listeners, in laymen terms, the tenth amendment!
Did our founding fathers believe that the northern states would want to handle
situations differently that the southern states?
Must we jump out of the skillet into the fire with the Republican proposal that
they say will reduce Health care costs?

Why do you say National medical
tort reform law is unconstitutional?
Should we "throw out the baby" - our constitutional rights - with the bathwater
- just to supposedly save nickel or two?
I know I believe, but do you believe, that warts and all, America is the best
country in the world because of our civil and criminal justice system?

The premise of the Tort
Reformers is that we will have more doctors and significantly reduced health
care cost if the tsunami of frivolous lawsuits is limited. Has this been proven
wrong?
Does limiting medical malpractice actually reduce the number of doctors? Says who?

Topic: Tort Reform
Discussed by Alex Winslow

Part 1 of 3
Texans were promised the ‘moon’ during the Medical-Malpractice Tort Reform
Debate in 2003. But what did Texans receive in exchange for giving up their 7th
Amendment Right to a Trial by Jury?
The Republican leadership in the State of Texas promised the citizens that they
would experience lower health insurance costs if they would just give up their
right to a trial by jury when harmed by a medical provider. Did this promise
come true – listen in for the stark reality. [Hint: NO!]
National Republican leaders are making bold promises that the way to bring down
health care costs is to limit an injured patient’s right to a trial by jury. How
has this worked out in Texas?

receive in exchange for giving up their 7th Amendment Right to a Trial by Jury?
Promised individual health insurance premium reductions have NOT occurred. More
doctors serving underserved areas has NOT occurred.
Med-Mal rates for doctors would come down, Texans were promised. Reality is,
rates have fallen nationally but not due to restricting a patient’s right to
hold a wrongdoer accountable.

Texans were promised
the ‘moon’ during the Medical-Malpractice Tort Reform Debate in 2003. But what
did Texans receive in exchange for giving up their 7th Amendment Right to a
Trial by Jury?
Overall, a relatively small number of doctors are responsible for the majority of
complaints filed with medical review boards. In Texas, the practice of looking
the other way or simply slapping the hands of an egregious doctor has simply
continued since the patient’s right to hold them accountable has been severely
limited.
The quality of patient care has not improved since 2003. Bad doctors are still
practicing bad medicine.

Topic: Tort Reform
Discussed by Mary Alice McLarty
with Mary Alice McLarty (www.MaryAlice.com)
Part 1
Have consumers, doctors and/or patients benefited from Medical Malpractice
Tort Reform in Texas?
Consumers were told that their individual and family health insurance costs
would go down if they would just vote away their constitutional right to hold a
wrong doer accountable. But have their individual rates go down? [Hint: “No.”]
Are more bad doctors having their licenses revoked since Texans voted to shield
Doctors from their mistakes? [Hint: “No”.]
Our founding fathers placed high on their list of grievances against King George
the loss of their right to a trial by jury. All Americans should
think long and hard before giving up their constitutional right to a trial by
jury.

Were Texans lied to by their elected officials leading up to the statewide vote

Are patients in Texas safer because of Medical Malpractice Tort Reform? The
clear answer is NO.
