30 years ago, did consumers just jump up and organize and say "you know there are too many frivolous lawsuits, lets band together into groups like Texans for Lawsuit Reform, etc!"?

Is this a planned out effort that has been going on for years?

In Texas, Big Business, Big Insurance, and their elected officials are stating: The purpose of tort reform is to reduce the amount of meritless – or frivolous – litigation and excessive awards. Former Judge John Devine uses the story of the “Straw Man” to explain the pending Loser Pays Bill – HB 274, currently in the Texas Senate. Baylor College of Law surveyed the Texas Civil judges who responded that there was no need for further legislation addressing frivolous lawsuits. So why did Governor Perry elevate this issue as “An Emergency Issue”? Does he need a “Straw Man”?

Former Judge John Devine explains ‘The Law of Unintended Consequences’. You may be harmed in a car accident and win a judgment but still lose by being forced by the judge to pay the defendant’s attorney fees. You may experience a natural disaster and win a suit against your insurance company but still lose by being forced by the judge to pay the insurance companies attorney fees. As a small business owner, you may bring a cause for action in a breach of contract case, win but still lose by being forced by the judge to pay your opponent’s attorney fees. Title: Is Our Civil Justice System Patterned After God’s Word Found in the Bible?
Topic: Loser Pays Will Harm Texas Families and Small Businesses
Discussed by Mark Lanier
with Biblical Literacy (www.Biblical-Literacy.com)

Did God have the writers in the Old Testament write about property rights? Did God instruct Moses to write about justly compensating an injury party? Renowned attorney and bible study leader Mark Lanier highlights several biblical concepts that our civil justice system patterns itself after. In our scrolling banner above, you can read for yourself the biblical basis for our civil justice system.

Mark also discusses the egregious bill being debated in the Texas Senate call “Loser Pays”. Baylor Law Review went to the “Horses Mouth” to determine if the courts were being clogged with frivolous lawsuits and to see if Texas Courts are experiencing problems with “runaway juries” awarding excessive amounts. The Trial Judges in Texas responded with a clear NO. 86% of the judges who responded to the Baylor Law Review Survey stated that there was no need for further legislation addressing frivolous lawsuits. Are Big Business, Big Insurance Companies, and their high priced lobbyists? What should all Texans do?

We are urging everyone to contact their Texas State Senator and urge them to vote NO on the “Loser Pays” Bill. Call the switchboard at the Texas Capital @ 512.463.4630 and urge all your friends to call also.

Title: Mike and Mary’s Accounting Services
Topic: Loser Pays Will Harm Texas Families and Small Businesses
Discussed by Steve Waldman
with Steve Waldman (www.waldmanfirm.com)

Segment 1 of 4

Hypothetically - Mike and Mary own a small accounting services firm. They purchase $100,000 of computers and software from a company to completely upgrade their office. Could the “Loser Pay” bill, which is currently being debated in Austin, drive them out of business? Or worse - force THOUSANDS of small businesses to move out of Texas? Steve Waldman, small business owner and attorney, joins us today sounding the alarm against this bad legislation. More on the story about Mike and Mary:

  1. Mike and Mary’s Accounting Services ("Mom and Pop" small business) buys 10 Computers including software at a cost of $100,000.

  2. The computers and software do not work, costing Mike and Mary to lose most of their business.

  3. Mike and Mary sue the Computer/Software Company for the $100,000 cost of the computers and software plus $50,000 in lost profits.

  4. Early in the litigation, the seller offers Mike and Mary $80,000 to settle. Mike and Mary turn it down because they have lost $150,000.

  5. Mike and Mary go to trial and win $60,000. The jury finds Mike and Mary had 40% of the use of the computers and software, and the judge disallows Mike and Mary’s lost profits claim on a technicality (lost profits claims are difficult to prove, even when they are legitimate).

  6. Because Mike and Mary won less than 80% of company’s offer, they have to pay the company’s attorney fees and litigation expenses after declining its offer of settlement.

  7. The company’s law firm has assigned several lawyers and paralegals to defend the case, and runs up $350,000 in legal fees and litigation costs.

  8. Mike and Mary are awarded $60,000, less the company’s $350,000 in legal fees. In other words, Mike and Mary have won their lawsuit but NOW owe THE COMPANY $290,000!

  9. Mike and Mary file for bankruptcy.

    with Steve Waldman (www.waldmanfirm.com)

Steve Waldman continues discussing the story about Mike and Mary’s Accounting Services. Is the outcome of the story fair? I wonder how many listeners have ever had to fight an insurance company because of a car wreck caused by someone else and their insurance company refused to settle, delayed settling, and / or offered a ridiculous low offer? How many have suffered wind damage, hail damage, tornado or hurricane damage and their own insurance company employed the “Big 3 Tactics”: Deny/Delay/Under-pay. Sound familiar? If you think insurance companies play hard-ball now, if “Loser-Pays” passes the Senate, all Texans will suffer.

Steve Waldman continues discussing the story about Mike and Mary’s Accounting Services. Big Business and Big Insurance is seeking a shield to hide behind. Not wanting to be held responsible for their activities and/or products, they now want their friends in Austin to give them a free pass.

    with Steve Waldman (www.waldmanfirm.com)

What would cars be like without the civil justice system? Steve Waldman, small business owner and attorney, answers that question. The car manufactures fought ‘tooth and nail’ against the eleven safety changes listed (click on the scrolling banner on the top of our home page).

The safety changes include safer gas tanks, better door latches, Electronic Stability Control, air bags, stronger safety precautions to keep cars from slipping out of Park, safer tires, better side impact protection, safer seats, better seat belts, safer power windows, and stronger support for car roofs. Without the injured parties or their family members suing and winning time and time again, the car manufactures would not have made these and many other changes.

The ‘loser pays’ idea was rejected by our founding fathers, and all Texans are urged to tell the State Senators we do not want it now.

Title: TORT Reform: Legitimate Crisis or Big Business Bullying?
Topic: Loser Pays Will Harm Texas Families and Small Businesses
    Discussed by Steve Harrison
    with Harrison-Davis-Steakley-Morrison, P.C. (www.thetriallawyers.com)

    Segment 1 of 2

Straight from the horse’s mouth: judicial observations of jury behavior and the need for tort reform. Mr. Harrison joins us from Waco discussing a Baylor Law Review Study that surveyed Texas district court judges. Out of 389 Texas District Court Judges, 303 completed surveys with an impressive response rate of 78%. Some of the survey results:

--83% observed not a single instance of a “runaway jury verdict”
--44% had not personally observed a single frivolous lawsuit in their courtroom during the prior four years
--86% of the responding judges believed that there was no need for further legislation addressing frivolous lawsuits

The Judges throughout Texas are NOT pushing for more Tort Reform Legislation. So who is? Big Business and Big Insurance Companies and their lawyers are the ones pushing for a shield against being held accountable and responsible for their actions.

Steve Harrison continues discussing a Baylor Law Review Study that surveyed the Texas District Court Judges. Is tort reform motivated by a legitimate tort crisis, by false perceptions or worse – by a business and insurance lobby that is both powerful and cunning in its use of innuendo and misinformation?

The trial judge is in a position to see the same evidence as the jury and yet be completely non-partisan and has the benefit of seeing the jury system at work. The Baylor survey results confirm that most Texas trial judges do not see significant numbers of frivolous filings and they do not see the need for further legislation addressing frivolous lawsuits.
