Hypothetically - Mike and Mary own a small accounting services firm. They
purchase $100,000 of computers and software from a company to completely upgrade
their office. Could the “Loser Pay” bill, which is currently being debated in
Austin, drive them out of business? Or worse - force THOUSANDS of small
businesses to move out of Texas? Steve Waldman, small business owner and
attorney, joins us today sounding the alarm against this bad legislation. More
on the story about Mike and Mary:
- Mike and Mary’s Accounting Services ("Mom and Pop" small business) buys 10 Computers including software at a cost of $100,000.
- The computers and software do not work, costing Mike and Mary to lose most of their business.
- Mike and Mary sue the Computer/Software Company for the $100,000 cost of the computers and software plus $50,000 in lost profits.
- Early in the litigation, the seller offers Mike and Mary $80,000 to settle. Mike and Mary turn it down because they have lost $150,000.
- Mike and Mary go to trial and win $60,000. The jury finds Mike and Mary had 40% of the use of the computers and software, and the judge disallows Mike and Mary’s lost profits claim on a technicality (lost profits claims are difficult to prove, even when they are legitimate).
- Because Mike and Mary won less than 80% of company’s offer, they have to pay the company’s attorney fees and litigation expenses after declining its offer of settlement.
- The company’s law firm has assigned several lawyers and paralegals to defend the case, and runs up $350,000 in legal fees and litigation costs.
- Mike and Mary are awarded $60,000, less the company’s $350,000 in legal fees. In other words, Mike and Mary have won their lawsuit but NOW owe THE COMPANY $290,000!
- Mike and Mary file for bankruptcy.

during the prior four years
