Big business has been buying their protection by funding candidates for state and federal office. Big business has also been funding a national movement selling average Americans on the false idea that there is a tsunami of frivolous lawsuits. But is all this based on lies?

Tort reformers have three agendas:

1. Make it impossible for the person that is harmed or injured to recover money damages
2. Make it impossible for the person that is harmed or injured from receiving effective representation – from being able to hire an attorney
3. Make it impossible for an attorney to make money representing an injured American

For too long, too many have been drinking the cool-aid believing that there are too many frivolous lawsuits in America so we must do whatever it takes to shut the court house door to these suits. But in doing so, it closes the court house to all!

Hypothetically - Mike and Mary own a small accounting services firm. They purchase $100,000 of computers and software from a company to completely upgrade their office. Could the “Loser Pay” bill, which is currently being debated in Austin, drive them out of business? Or worse - force THOUSANDS of small businesses to move out of Texas? Steve Waldman, small business owner and attorney, joins us today sounding the alarm against this bad legislation. More on the story about Mike and Mary:

  1. Mike and Mary’s Accounting Services ("Mom and Pop" small business) buys 10 Computers including software at a cost of $100,000.

  2. The computers and software do not work, costing Mike and Mary to lose most of their business.

  3. Mike and Mary sue the Computer/Software Company for the $100,000 cost of the computers and software plus $50,000 in lost profits.

  4. Early in the litigation, the seller offers Mike and Mary $80,000 to settle. Mike and Mary turn it down because they have lost $150,000.

  5. Mike and Mary go to trial and win $60,000. The jury finds Mike and Mary had 40% of the use of the computers and software, and the judge disallows Mike and Mary’s lost profits claim on a technicality (lost profits claims are difficult to prove, even when they are legitimate).

  6. Because Mike and Mary won less than 80% of company’s offer, they have to pay the company’s attorney fees and litigation expenses after declining its offer of settlement.

  7. The company’s law firm has assigned several lawyers and paralegals to defend the case, and runs up $350,000 in legal fees and litigation costs.

  8. Mike and Mary are awarded $60,000, less the company’s $350,000 in legal fees. In other words, Mike and Mary have won their lawsuit but NOW owe THE COMPANY $290,000!

  9. Mike and Mary file for bankruptcy.

    Steve Waldman continues discussing the story about Mike and Mary’s Accounting Services. Big Business and Big Insurance is seeking a shield to hide behind. Not wanting to be held responsible for their activities and/or products, they now want their friends in Austin to give them a free pass.

    Baylor Law Review went to the “Horses Mouth” to determine if the courts were being clogged with frivolous lawsuits and to see if Texas Courts are experiencing problems with “runaway juries” award excessive amounts. The Trial Judges in Texas responded with a clear NO. 86% of the judges who responded to the Baylor Law Review Survey stated that there was no need for further legislation addressing frivolous lawsuits. So who is pushing for this: Big Business, Big Insurance Companies and their high priced lobbyists. What should all Texans do?

    What would cars be like without the civil justice system? Steve Waldman, small business owner and attorney, answers that question. The car manufactures fought ‘tooth and nail’ against the eleven safety changes listed (click on the scrolling banner on the top of our home page).

    The safety changes include safer gas tanks, better door latches, Electronic Stability Control, air bags, stronger safety precautions to keep cars from slipping out of Park, safer tires, better side impact protection, safer seats, better seat belts, safer power windows, and stronger support for car roofs. Without the injured parties or their family members suing and winning time and time again, the car manufactures would not have made these and many other changes.

    The ‘loser pays’ idea was rejected by our founding fathers, and all Texans are urged to tell the State Senators we do not want it now.
