Straight from the horse’s mouth: judicial observations of jury behavior and the need for tort reform. Mr. Harrison joins us from Waco discussing a Baylor Law Review Study that surveyed Texas district court judges. Out of 389 Texas District Court Judges, 303 completed surveys with an impressive response rate of 78%. Some of the survey results:

--83% observed not a single instance of a “runaway jury verdict”
--44% had not personally observed a single frivolous lawsuit in their courtroom during the prior four years
--86% of the responding judges believed that there was no need for further legislation addressing frivolous lawsuits

The Judges throughout Texas are NOT pushing for more Tort Reform Legislation. So who is? Big Business and Big Insurance Companies and their lawyers are the ones pushing for a shield against being held accountable and responsible for their actions.

Steve Harrison continues discussing a Baylor Law Review Study that surveyed the Texas District Court Judges. Is tort reform motivated by a legitimate tort crisis, by false perceptions or worse – by a business and insurance lobby that is both powerful and cunning in its use of innuendo and misinformation?

The trial judge is in a position to see the same evidence as the jury and yet be completely non-partisan and has the benefit of seeing the jury system at work. The Baylor survey results confirm that most Texas trial judges do not see significant numbers of frivolous filings and they do not see the need for further legislation addressing frivolous lawsuits.
