Title: Paid Sick Leave: Good or Bad?
Topic: Paid Sick Leave
Discussed by Annie Spilman
with National Federation of Independent Business (www.NFIB.org)

Part 1 of 3

Recently, Annie Spilman was a panelist at a forum sponsored by the Texas Public Policy Foundation. The topic was the “Cost and consequences of mandating paid sick leave for employees working inside the city limits of Austin”. Annie is the Legislative Director of the National Federation of Independent Business (NFIB) – Texas.

Questions/Issues Discussed:

What is NFIB and who do they represent?

What workers are exempt from Austin’s paid sick leave benefits?

Questions/Issues Discussed:

Paid sick leave is a great idea…on paper. But is it really a good plan for “every business”?

Under the Federal Medical Leave Act, aren’t workers allowed paid time off?

Is NFIB fighting hard to keep this sort of mandate away from other cities in Texas (and across the nation)?

How is the paid sick leave calculated?

Does the Austin ordinance allow for a city “Czar” to oversee ALL employment records for ALL businesses within the city limits, including small businesses? Listen as Annie explains why this is so extremely dangerous – for everyone.

Questions/Issues Discussed:

Did the Austin City Council site any studies showing a need for government-mandated paid sick leave for all employees?

Did the Austin City Council site any studies showing either a positive or negative effect on employees who receive government-mandated sick leave?

What are small businesses expressing to NFIB concerning this issue?

Do most employers already provide paid sick leave to their employees? Why the need for a government-mandate then?

Rhetorical Question: Do we just roll over and accept this atrocity or should we fight back?

If you are a small business owner concerned over this issue, please contact NFIB at 512.476.9847 or click here.

Title: The Cost and Consequences of Mandating Paid Sick Leave
Topic: Paid Sick Leave
Discussed by Ryan Walters
with Texas Public Policy Foundation (www.TexasPolicy.com)

Part 1 of 3

The City of Austin has adopted a new mandate for businesses, set to go into effect on October 1, 2018. The Texas Public Policy Foundation and other organizations have filed suit against the City, challenging the order.

Questions/Issues Discussed:

The City of Austin recently enacted a city ordinance mandating paid sick leave/time off for all employees with the City of Austin. Does everyone deserves paid sick leave?

NOTE: We are NOT disputing the NEED for paid sick leave. We actually think it is a GOOD THING! What is the issue, then?

Title: Part 2 of 3 - The Cost and Consequences of Mandating Paid Sick Leave
Topic: Paid Sick Leave
Discussed by Ryan Walters
with Texas Public Policy Foundation (www.TexasPolicy.com)

Questions/Issues Discussed:

Which businesses are mandated to give employees paid sick leave?

Does each employee receive 1 hour sick leave for each pay period wherein they work 30 hours or more? Is this going to add headache upon headache for employers, not mention an egregious financial burden?

SHOCKER: City of Houston employers/employees are exempt from this ordinance!

Were there Town Hall meetings prior to the vote on this ordinance? Were they well-advertised? Did Union members and lobbyists attend the meetings, pushing for the ordinance passage?

Was the owner of County Line BBQ (where this issue began) bullied into silence at the Town Hall meetings?

Questions/Issues Discussed:

Who’s pushing and funding this movement?

Is this an example of the government doing something, but not knowing what they were doing and why there were doing it?

Can ANYONE make anonymous complaints about a business concerning this issue? What will happen to the business in this situation?

The Texas Public Policy Foundation and others have filed suit against the City of Austin to fight this unlawful ordinance. Ken Paxton, the Texas Attorney General, has stepped up to take over the suit, helping ALL Texans. Listen as Ryan Walters explains why…

Title: New Paid Sick Leave in Austin: Good or Bad?
Topic: Paid Sick Leave
Discussed by Ryan Walters
with Texas Public Policy Foundation (www.TexasPolicy.com)

New guest, Ryan Walters, is an attorney with the Center for the American Future at the Texas Public Policy Foundation.

Today, Ryan will be discussing a mandate for businesses within the city of Austin. The mandate, set to go into effect October 1, 2018, is being challenged by The Texas Public Policy Foundation and other organizations in court.

Questions/Issues Discussed:

Texas is a “Right to Work State”. Listen as Ryan Walters explains what that means….

Texas is also an “At Will Employee State”. What does that mean?

What is the Texas Minimum Wage Law?

Can Texas cities or counties adjust the minimum wage to whatever they see fit?

Why does the new Austin ordinance exempt Unions?

If a business has multiple locations across Texas, including within Austin, must the business offer paid sick leave to ALL of its employees statewide? If not, is this fair to others?

Why is the TPP challenging this law in court? Are other business organizations joining TPP to oppose this law?
