Title: New Bill to Protect Your Rights
Topic: Deny, Delay, and Underpay!
Discussed by Ware Wendell
with Texas Watch (www.TexasWatch.org)

Insurers are destroying lives by denying and delaying legitimate claims. HB1739  would restore your rights, forcing your insurance company to fulfill the agreement they made with you when you signed your insurance policy.

Ware Wendell is the Executive Director of Texas Watch. He is dedicated to giving a voice to the need for public safety and full accountability through our civil justice system.

Questions/Issues Discussed:

Do insurance companies use delaying tactics to intentionally slow the payment of claims?

Is corporate responsibility just as important as personal responsibility?

Would Texas HB1739 restore rights of those insured?

Does HB1739 have strong bipartisan support?

Call your Representative today to urge a “for favor” vote on HB1739. The Austin Capital Switchboard phone number is: 512.463.4630.

You can also call Representative Walter Thomas “Four” Price, head of the calendar committee, at 512.463.0470 and urge him to push this bill through quickly for a vote.

Title: Watch Out for the Insurance Adjusters!
Topic: Deny, Delay, and Underpay!
Discussed by Alex Winslow
with Texas Watch (www.TexasWatch.org)

Texas flood victims beware! Not only do you need to be careful of scammers during this difficult time, you need to be extra cautious about your own home, business, and car insurance company representative. Yes, as crazy as it sounds, they are NOT in business to help you, but to help themselves!

Alex Winslow, with Texas Watch, has some advice for every desperate home, business, and car owner today.

Questions/Issues Discussed:

Is rising water and falling water the same? Are they both covered under “normal” home or business insurance?

Why should people document everything?

Is having a timeline of events, phone calls, home visits, etc important?

Why do insurance adjusters deny, delay, and underpay?

Title: What to do After the Flood?
Topic: Deny, Delay, and Underpay!
Discussed by Alex Winslow
with Texas Watch (www.TexasWatch.org)

Texas flood victims beware! Not only do you need to be careful of scammers during this difficult time, you need to be extra cautious about your own home and car insurance company representative. Yes, as crazy as it sounds, they are NOT in business to help you, but to help THEMSELVES!

Alex Winslow, with Texas Watch, explains that there is a major difference “falling water” and “rising water”. Years ago, individual home insurance companies stopped covering damage due to “rising water” (aka flood water) but not “falling water”. “That’s why it is so important that folks who live in flood-prone areas buy a supplemental flood insurance policy,” Alex states.

If you have any type of damage, Alex suggests documenting ALL expenses, including hotel and food costs – even how much you spend at the laundromat to wash your clothes! “In addition, you want to keep a record of all your interactions with your insurance company,” Alex says. He recommends keeping a notebook with all the phone calls you’ve made and who you talked with, keep all email correspondence, and record when the adjuster comes to view the damaged property. Listen in as he gives more advice on this.

Another thing to remember is that there are timelines that must be followed – by you and the insurance company. “Most insurance claims are handled promptly and fairly and everybody’s happy at the end of the day,” Alex says. “But there is a significant rise in the number of claims where people aren’t being treated properly.”

Don’t let anyone take advantage of your vulnerability. Your insurance company will do everything in their power to delay, delay, delay your claim. Don’t let them do that! A great tragedy has occurred in your life and you deserve to be treated fairly, with dignity and respect. If you feel as if you are being treated poorly, do not hesitate to hire a licensed public adjuster or lawyer who specializes in insurance claims disputes.

Know the facts now. Even if your insurance company isn’t trying to delay payment, they will attempt to underpay you. “We see this way too often,” Alex says. “This is a tactic insurance company’s use, because it is put in writing.” Plus, the insurance company knows that the longer they low-ball you as you fight back, the longer they can delay paying you what you deserve!

If disaster strikes your home, don’t sign anything! Insurance adjusters will offer you a check on the spot and ask you to sign paperwork saying you received the money. But - don’t sign! Oftentimes, you are signing away any chance of recovering the total amount due to you. Call attorney Phillip Sanov, with The Lanier Law Firm, at 713.659.5200 or log on to www.LanierLawFirm.com

Don’t wait until Hurricane season to take inventory of your valuables. Anything can happen at anytime. If you do not have pictures, receipts, or any kind of documented proof of your valuables, the insurance company is less likely to give you what they are worth. Also, store the information in a safe place, such as a safe deposit box, or with a friend or relative. Log on to www.texaswatch.org for more information on how to protect yourself from sneaky insurance adjusters.
