Title: Can China Be Sued?
Topic: Mark Lanier Comments on China
Discussed by W. Mark Lanier
with Lanier Law Firm (www.LanierLawFirm.com)

On Friday, May 1st, we had Riley Walters on to discuss “China Must Be Held Accountable for COVID-19”. Riley is a Policy Analyst in the Davis Institute for National Security and Foreign Policy at The Heritage Foundation.

Today, attorney Mark Lanier discusses the logistics of a possible lawsuit against the Chinese Government. Mark Lanier can be found here.

Questions/Issues Discussed:

Worldwide, hundreds of thousands have died from the coronavirus with over 60,000 deaths across the US. In Mark’s opinion, who is to blame? Is God to blame? Is China to blame? Are individual governments to blame?

Can China be held responsible and liable for damages? What court would have jurisdiction?

What is “discovery”? Will discovery be problematic in any Coronavirus lawsuit? Is this an expensive process?

Do we need to change or update some laws in the US regarding this issue? Can bi-partisan legislators work together? Why is Mark Lanier pursuing this issue so passionately? Hint: if a wrongdoer is not held accountable, they will just commit wrong again…and again…

What are the odds of a successful lawsuit? What are the odds of successfully recovering money damages?

Title: Is Suing a Person Biblical?
Topic: Opioid Update
Discussed by W. Mark Lanier
with Lanier Law Firm (www.LanierLawFirm.com)

What does the Bible say about suing another person? Mark Lanier, Founder of the Lanier Law Firm, has some answers…

Questions/Issues Discussed:

Does the Bible, specifically in the Old Testament, have instructions for the roof-top builder, the oxen-owner, and the well-digger? Do those instructions and words of caution have application today?

Was our legal code modeled after the Bible? How is this different than other countries in the world?

What is a plaintiff attorney? Why did Mark Lanier choose this career path? He says: “I wanted to be a lawyer who helped David fight Goliath.

Recently, the Lanier Law Firm represented two counties in Ohio win a large opioid settlement. What are opioids? Are they addictive? Can opioids cause death? Is it the Lanier Law Firm’s contention that the distributors, manufacturers, and retailers of opioids are at fault for this epidemic?

How much was the award? Who was the lawsuit against? Is this settlement just the tip of iceberg? Mark also explains how his law firm is giving back into the community to help stop the opioid epidemic.

Mark is also a Bible Study teacher at Champion Forest Baptist Church – Champions Campus. Click here  for more information on his class in Houston. Regardless of religious background, YOU are welcome! You might even get to sit next to Terry Lowry and his wife, Kathy!

Attorney Mark Lanier recently won a huge battle in court against the company Johnson & Johnson. Today, Mark will be discussing the case, why the victory is so significant, and how it will affect future lawsuits.

What went through Mark’s mind when he was told the jury was back with its verdict after only five hours of deliberations?

Was there a witness for Johnson & Johnson who was in complete denial concerning their wrongdoings?

Title: Lanier Theological Library
Topic: Mark Lanier Theological Library
Discussed by W. Mark Lanier
with Lanier Law Firm (www.LanierLawFirm.com)

Most Theological Libraries are located just where you would expect – at Christian Seminaries! But one of the largest is located right in NW Houston. Mark Lanier has a FREE Theological Library on his private property that everyone can use, not just those studying at a seminary. Many ministers and pastors have found a great resource and its free to use.

The Mark Lanier Theological Library is home to 100,000 volumes and numerous artifacts, including a Dead Sea Scroll fragment, coins and weapons from the Biblical era, and the largest C.S. Lewis collection in the Southern United States with hand-written letters! Eighteen seminaries and grad schools use the Mark Lanier Theological Library as their principal research source. Many people use the Mark Lanier Theological Library every day – all for FREE!

Mark explains how he was able to acquire such a large volume of Theological books. It wasn’t easy, but it was definitely worth it! They have received volumes from Australia, Israel, Europe, England, Belgium, and Germany, as well as many other places across the US and the world. The Mark Lanier Theological Library is truly amazing and a great place to visit for FREE, even if you don’t need to do any research!

In addition to The Mark Lanier Theological Library, there is also a replica of a Byzantine church from 500 A.D. originally built in Tomarza, Cappadocia (Turkey) on the premises. The Stone Chapel was built using photos of the original church ruins taken in 1909, as well as an analysis of the site by a Harvard student published in 1971. They kept most of the same architecture as the original structure, obviously using a different type of glass for the windows and adding in the modern convenience of air conditioning. BONUS: Listen in as Mark explains why the Stone Chapel is facing east.

Finally, Mark Lanier invites you to join him at the Theological Library on Friday, May 6 from 2:30 pm – 4:00 pm to hear British New Testament Scholar Dr. Simon Gathercole and others in a panel discussion concerning New Testament topics: Was Jesus married, and the Doctrine of Atonement. Then, on Saturday evening, May 7, at 7:00 pm, Dr. Gathercole will present a lecture that is separate from the panel discussion. Both events are FREE to the public, but you must register in order to attend, as seating is limited.

To register for this free panel discussion on Friday, May 6, click here.

To register for the lecture on Saturday, May 7, at 7 p.m. click here.

Title: Who You Gonna Call?
Topic: What’s Needed to Sue
Discussed by W. Mark Lanier
with Lanier Law Firm (www.LanierLawFirm.com)

Mark Lanier is a long-time friend and sponsor of the What’s UP Radio Program. Many listeners are aware that Mark leads a large Life Group Class every Sunday at Champion Forest Baptist Church in Northwest Houston. We air portions of his lesson during each program. Click here  for more information about his class.

Today, Mark Lanier is a special guest to discuss the ins and outs of his personal profession as a lawyer. Mark says, “In my heart of hearts, my first calling is to proclaim the Lord and His Work and His Kingdom. I just practice law to pay the bills.

First, Mark laughs at the thought that it is “easy” to sue someone. A good, reputable lawyer is not going to just sue anyone and everyone on a whim. There must be a valid reason! “Law is like any other profession. You’ve got good one, bad ones, and mediocre ones. You want a lawyer who will help you and won’t take advantage of you or the system on your behalf,” Mark says. Listen in as he discusses good questions a good lawyer should ask and his philosophy of a “three-legged stool”: liability, damage, and collectability.

We often here about “frivolous lawsuits”. Are there really a lot of them? Or do we just here about the crazy ones? Mark explains that one type of “frivolous lawsuits” is where “someone is not really hurt and they want to buy a lottery ticket, just hoping they hit the big dollars”.

The other type of “frivolous lawsuits” is one against big insurance companies who refuse to pay a victim the amount they deserve. How can this be “frivolous”, though? Isn’t this a legitimate case? Listen in to hear Mark’s explanation of this one! It might not be what you think it is.

Mark also discusses contingency basis and fees. Many lawyers demand large amounts of money upfront in order to represent you. Mark Lanier and the lawyers at his firm do not do this. They do not accept a dime from clients until they win your case. This also means they will not be paid if they lose! “This means [our lawyers] must try really hard to maximize the recovery and to do it as quickly and efficiently as possible,” Mark says.

Title: The Foreign Manufacturers Legal Accountability Act
Topic: Consumer Safety
Discussed by W. Mark Lanier
with Lanier Law Firm (www.LanierLawFirm.com)

Over ¾ of all CPSC (Consumer Product Safety Commission) recalls in 2012 were made by foreign manufacturers. Foreign companies, however, are able to evade US laws and safety standards because it is extremely difficult for them responsible in US courts.

There has been a new bill introduced by a democrat and a republican entitled the “Foreign Manufacturers Legal Accountability Act of 2013” or HR 1910.

Mark Lanier, with the Lanier Law Firm, is here today to discuss the importance of this bill.

Title: Memories of Christmas Past: Thank You Mark and Becky Lanier
Topic: Christmas
Discussed by W. Mark Lanier
with Lanier Law Firm (www.LanierLawFirm.com)

Mark Lanier is a long-time sponsor of The What’s UP Radio Program. He is a wonderful father and husband, generous employer, and remarkable friend.

Twenty years ago, Mark began hosting an annual Christmas party at his home in Houston for clients, employees, and friends. Over the years, the party grew to tremendous lengths, requiring months of preparation and costing more and more every year. The parties were magnificent, with special guests ranging from Bill Cosby to Tim McGraw and Faith Hill!

Mark loved being able to give the people in his life, many who had endured very difficult and dark situations, one day of joy, completely free. Listen in as Mark reminisces about Christmas Parties from the past and explains why he and Becky decided to end the Christmas Party tradition.
